1. The agreement
These terms are between you and Wise Eyes LLC, Southfield, Michigan, and cover your use of Focal VT. By creating an account you accept them. If you do not, do not use the program.
2. Who may use it
Accounts are created by an adult parent or guardian using a code from a prescribing eye doctor. You are responsible for your login and for supervising your child's use. The program is not open to the general public and is not intended for a child to sign up for on their own.
3. What this is, and what it is not
Focal VT delivers vision-therapy exercises prescribed by your doctor and reports how they went. It does not diagnose, and it does not replace an eye examination or your doctor's judgement. Nothing shown in the app is medical advice. Decisions about your child's care belong to your doctor.
Vision therapy outcomes vary. We do not promise any particular result, and completing the program does not guarantee improvement.
4. Stop if something is wrong
Discontinue use and contact your doctor if your child develops headaches, eye pain, double vision, dizziness, nausea, or any new or worsening symptom. Do not use the exercises while unwell or excessively tired. If your child has a seizure disorder, discuss the moving and flickering visual targets with your doctor first.
5. Equipment
Some exercises need red/blue glasses and a lens paddle supplied or recommended by your doctor. Use only the power your doctor prescribed — a stronger lens is not a faster result. Screen calibration matters: if the setup steps are skipped or done carelessly, the exercises will be delivered at the wrong size and the results will be misleading.
6. Your account
Keep your login private, give accurate information, and tell us if you think someone else has access. Do not share an account between families, attempt to reach another patient's data, interfere with the service, or copy or reverse-engineer any part of it.
7. Ownership
The software, exercises, designs, and content are owned by Wise Eyes LLC and licensed to you for your child's personal, non-commercial use during their prescribed program. Clinical records generated remain yours and your doctor's; we hold them as described in the Privacy Policy.
8. Availability
We aim to keep the service running but do not guarantee it will be uninterrupted or error-free. We may change, suspend, or discontinue features, and will give reasonable notice of anything that materially affects an active program.
9. Disclaimers and liability
Except where the law does not allow it, the service is provided “as is” without warranties of any kind. Wise Eyes LLC is not liable for indirect or consequential damages, and our total liability is limited to the amount you paid for the program in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.
10. Ending use
You may stop at any time and ask us to delete the account. We may suspend an account that breaches these terms or is used in a way that risks a patient's safety or privacy.
11. Governing law
These terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules.
